“LEGAL CONTROVERSIES PERTAINING TO THE USE OF FORCE OF THE UNSC MANDATE IN LIBYA”

Introduction

The tragedy of the African continent will remain inscribed in human history. For centuries Europe colonized enslaved and exploited the African resources. Even more dramatic are the blood-soaked battles for colonial independence in the 20th century. Perhaps this is the reason why the European use of force in Libya in the 21st century might leave some with an awkward feeling. Does the West truly have a right to intervene, after all that has been done previously? Or does Europe have a duty to intervene after all that has been done to show the “correct ways of liberal democracy”? [2]

On March 19th 2011, a number of NATO countries engaged in a military intervention against Libya as “Operation Odyssey Dawn”. Claims were made that the event was the most successful mission of the NATO alliance in history. [3] In accordance with the representatives, the intervention was a necessity to protect human rights, civil lives and democratic development of the country.

The Rebel Griot: When are humans not human? Libya, Liberalism and the incineration of the armies of the global South

This article makes some excellent points regarding the de-humanisation of soldiers defending their country from imperialist attack and the complicity of liberals in these wars however I feel it to some extent inadvertently plays into the NATO narrative that precautions were taken to minimise civilian casualties... the widespread civilian deaths caused by NATO bombing and their rebel shock troops isn’t addressed. [Nasser]

Of course, civilians were killed by NATO as well - and not just mistakenly either. Defence Secretary Liam Fox effectively admitted that Gaddafi’s baby grandchildren (all aged between 6 months and 2 years), blown to pieces by NATO in late April last year, were deliberately targeted as part of a strategy to “put psychological pressure on Gadaffi”. But these deaths were at least reported as deaths in the Western media, and briefly caused some controversy. Likewise, the Guardian reported on its front page the news that NATO had deliberately left 61 migrants to die of thirst in the Mediterranean, some of the 1500 civilians estimated to have died there whilst attempting to flee NATO’s war.
Deaths of Libyan soldiers, however, were never reported by Western news corporations as deaths of human beings. At best, there were veiled references to the ‘degrading of Gaddafi’s military capability’ or of ‘Gaddafi’s capacity to attack civilians’. The latter is particularly odious. Soldiers have become, it seems, not human beings - people with lives, feelings and families – but merely the ‘capacity to attack civilians’.

Do you remember “Nayirah”?? No!!….
 OK, this is normal…
In regards to Iraq, the U.S. government brought a false witness to the U.S. Congress who while pretending to be a Kuwaiti nurse testified that Iraqi soldiers threw 312 Kuwaiti babies out of incubators to die.
This was used to galvanize public opinion in the U.S. in order to go to war with Iraq in 1991. The infamous Nurse Nayirah testimony was given by
Nijrah (Nayirah) Al-Sabah the daughter of the Kuwaiti envoy to Washington. She was even given acting lessons by a public relations (P.R.) firm before her false testimony, which George H. Bush Sr. referred to when justifying going to war with Iraq. The Media War on Libya: Justifying War through Lies and Fabrications

The last moment of martyr Omar Mukhtar [History repeat itself]

Mukhtar was tried, convicted, and sentenced to be executed by hanging [by Italians] in a public place. The fairness of his trial has been disputed by historians and scholars. When asked if he wished to say any last words, he replied with the Qur'anic clause:
“Inna lillahi wa inna ilayhi raji’un.”
"From Allah we have come, and to Allah we will return."
Omar Mukhtar led the rebellion against occupation of Libya

Saudi Arabia: 10 Truths Self-Censored by the West's Media Houses

by Tony Cartalucci
Gulf Despots photo Global Research.ca

1. Saudi Arabia is so utterly autocratic it is literally named after the ruling dynasty, the House of Saud. Thus it is Arabia of the House of Saud, or "Saudi Arabia."

2. To this day, Saudi Arabia carries out barbaric executions against both criminals and political enemies, including victims accused of "sorcery and witchcraft" in the aptly named, "Chop-Chop Square" located in the capital of Riyadh where heads are literally chopped off by hooded swordsmen.

3. Women are banned from driving in Saudi Arabia, and most likely would also be banned from voting in national elections, if such a phenomenon even occurred - which it does not - as Saudi Arabia is an absolute monarchy and its leaders are determined by heredity, not even the feigned pretense of elections. There are local elections, however, in which woman are not permitted to vote (perhaps in 2015?).

4. Saudi Arabia has been and to this day is the primary underwriter of the notorious international terror organization, Al Qaeda. Created along with Saudi Arabia's long-time ally, the United States, money, weapons, and directives are laundered through the Saudis to maintain both plausible deniability for the Americans, and to maintain a degree of credibility for Al Qaeda's sectarian extremist foot-soldiers across the Muslim World.

5. Saudi Arabia maintains an extensive "re-education" program internationally to pervert the tenants of Islam as a means of keeping Al Qaeda's ranks full and fueling Wall Street and London's engineered "Clash of Civilizations."

6. Saudi Arabian corporate-financier interests (run by the royal family) are tied directly to Wall Street and London via conglomerations like the US-Saudi Arabian Business Council and representation upon the JP Morgan International Council (Khalid Al-Falih of Saudi Aramco, amongst the highest valued companies on Earth).

7. The alleged most notorious terrorist in modern history, Osama Bin Laden, was a creation of US-Saudi machinations, with the Bin Laden family to this day being a premier member of of both Saudi and Western elitist circles. The multi-billion dollar Saudi Binladin Group is an active member of the US-Saudi Arabian Business Council and plays a central role in deciding bilateral policy for the benefit of collective US-Saudi corporate-financier and corresponding geopolitical interests.

8. The autocratic House of Saud maintains Al Arabiya, along with a extensive list of unsavory investors from across the GCC and its sphere of influence, including Lebanon's Hariri faction. It is a propaganda outlet masquerading as an objective journalistic organization, working in tandem with state-owned Al Jazeera in Qatar. Occasionally admitted to be "state media" by the West, "state media" in Saudi Arabia actually means "Saud family-owned propaganda."

9. Saudi Arabia has played an active role in the violent destabilization of governments around the world, including most recently Libya and Syria. The use of sectarian-extremists indoctrinated at Saudi-funded faux-mosques and madrasas, armed and funded by Saudi cash, is the standard method of operation for these destabilizations.

10. Saudi Arabia's brutally repressive internal security apparatus is a creation of US advisers and operators. Its military, both covert and conventional, is also armed through astronomically large weapons sales (including a recent sale considered the largest in US history) by its Wall Street and London allies. The atrocities committed by the despotic Saud regime are directly facilitated by US advisers, operators, and arms. Saudi Arabia also hosts the US military, a sizable force until it was spread out amongst the orbiting despotic regimes of QatarBahrainOman, and the United Arab Emirates.

Libya’s New Neo-Liberal “Democracy”

by Seth Rutledge
The recent Libyan elections have been praised by the western media.  Apparently Libya has finally set off on the path towards prosperity.  But how free and open were the elections, and what can we expect for the future of this proud and wealthy nation?

No democracy can function without an open media.  Yet the National Transitional Council has passed laws prohibiting free speech, article 37 says that Libyans can be jailed for “Speech that glorifies Kaddafi, insults Islam, insults the revolution, and lowers the moral of Libyan citizens”.1  News Anchors who stopped going to work in protest have been forced to return to work at gunpoint and report news that they don’t agree with.  The Libyan television stations broadcast through NileStat have been taken over by the NTC, Qatar, and western media outlets.2  A fair election with 3,000 candidates is impossible without free media and an open public discourse.

Syria: to rebuilding an image of enemy in the minds, so that NATO can do the next war

The Kronen Zeitung to falsify the report on Syria
But this is now not longer uncommon for the mass media.
Whether newspapers or on television, many fake reports and photographs come from another place or another time, when it comes to rebuilding an image of enemy in the minds, so that NATO can do the next war.

The Kronen Zeitung, commonly known as the Krone, is Austria's largest newspaper

With almost three million consumers with a population of about eight million, the ‘Krone’ is thus measured by the number of inhabitants one of the strongest, most successful and most influential newspapers in the world.
This does not prevent them to falsify the report on Syria.
Or is it because of this ?
The original [down] came from the European Pressphoto Agency (EPA),
but for the ‘crown’ presstitutes probably was not ‘dramatic’ enough [up] © Kronen Zeitung .

And to you ‘crown’ ‘Newspaper’ - you are the mother of all photo forger, or what ?

News about Saif Al Islam Gaddafi [crossfire of information]

Update 31.07.2012.

Saif Al Islam - The NATO's ICC and the NATO's  Libyan government are locked in a dispute over where Saif should be tried.

SITUATION IN LIBYA IN THE CASE OF THE PROSECUTOR v. SAIF AL-ISLAl^ GADDAFI and ABDULLAH ALSENUSSI
Original ICC document  link

"The only way for Libya and the Libyan people to have justice is for the ICC to try this case in a fair, impartial and independent manner," he was quoted as saying in a defence document submitted to the court on Tuesday.

"I would have liked to have been tried in Libya by Libyan judges under Libyan law in front of the Libyan people," Saif was quoted as saying in the document, issued after ICC lawyers visited him last month.
"There will also be no truth if witnesses are faced with possible life sentences for simply testifying in my favour," he said. "I am not afraid to die but if you execute me after such a trial you should just call it murder."

His lawyer Melinda Taylor said after her release she believed it would be "impossible" for Saif to be tried in an independent and impartial manner in Libyan " courts".
His lawyer Melinda Taylor and four ICC staff members were freed earlier this month after being held in Libya four almost four weeks while visiting Saif on behalf of the court.

Unsigned statement/sentiments from Mr, SaifAl Islam Gaddafi 7 June 2012, Zintan
1. I want to face justice.

2. I want to do so because I believe that Libya, the victims in Libya, the intemationally
community and myself- all have a right to the truth, and for the truth to be made
public,

3. / would have liked to have been tried in Libya by Libyan judges under Libyan law in
front ofthe Libyan people. But what has been happening in my case cannot be called a trial

4. The truth is only possible in a fair and impartial trial,

5. There will be no truth if I am kept locked up and silenced in a remote mountain village, with no or very limited possibility to speak to my lawyers in order to convey my defence,

6. There will also be no truth if witnesses are faced with possible life sentences for simply testifying in my favour, there is no security or protection for them, nor any consequences if these witnesses are threatened and killed,

7.  There will certainly be no justice in the case, if the prosecution is based on evidence extracted from torture and other inadmissible evidence, or persons who are too scared to say the truth,

8. I am not afraid to die but if you execute me after such a trial you should just call it murder and be done with it.

9.  would also prefer to live to see Libya become a democracy based on human rights and respect for the rule of law, but you cannot expect democracy to flourish if all the Libyan people see are show trials run by political expediency,

10. Over a year ago, representatives of the NTC asked the international community to intervene so that the Libyan people could have justice, I am asking for exactly the same thing - the only way for Libya and the Libyan people to have justice is for the ICC to try this case in a fair, impartial and independent manner, and, in so doing, set standards, which Libya can follow on its future path to democracy and the rule of law,

11. These were the sentiments, which Mr. Gaddafi wished to convey to the Honourable Pre-Trial Chamber, based on the views he had provided to the OPCD on 3 March 2012, and reconfirmed on 7 June 2012. When Mr. Gaddafi attempted to sign this statement after reading it, the guard, who had informed the ICC delegation through the interpreter that he was illiterate, did not understand English and that his sole purpose of being present was to ensure issues of physical security, confiscated the statement and brought it to Dr. Gehani to read.

The scale of the ongoing tragedy visited on Libya by NATO and its allies is becoming horribly clearer with each passing day. Estimates of those killed so far vary, but 50,000 seems like a low estimate; indeed the British Ministry of Defence was boasting that the onslaught had killed 35,000 as early as last May. But this number is constantly growing.

US-backed Occupied Libya: Putting Lipstick on a Frog

Farirai Chubvu

Elections to choose a new General National Congress in Libya are an attempt to provide a “democratic” facade for an authoritarian and undemocratic government, subservient to the interests of the major Western powers, corporations and banks.

The Nato-installed National Transitional Council ensured that candidacy was restricted to a relatively small layer approved by the Electoral Commission.

Syria: Libya 2.0 - Media Hysteria Over Syria "Bombing" City of Aleppo

If tired WMD lies won't convince the public to back foreign intervention, perhaps recycled lies from Libya? by Tony Cartalucci July 24, ...

Fishing for a Pretext

Between lies revolving around distorted statements regarding chemical weapons, fabricated atrocities, and now claims of airstrikes being used upon "civilian populations," the West is desperately running down the list for a "casus belli" that will stick. The Syrian government, after a year and a half of being undermined by foreign interests and hordes of foreign militants, has maintained both the faith and trust the majority of its population has put into it. If it is deploying airstrikes, it can be assured they are doing so with keeping that faith and trust intact - and as the West often claims in the midst of its military adventures, doing so to minimize as much as possible collateral damage.

Recent attacks by the FSA have aimed at undermining that faith and truth, and militants in the northern city of Aleppo have purposefully moved to the commercial center of the city to draw in the heavy weapons necessary to neutralize them. While the Western press portrays this move toward the center of Aleppo as "progress," it should be noted that the Syrian military operates out of bases on the city's outskirts.

This means the further militants push toward the center of the city, the further from engaging the military directly they become. While the FSA claims they are "liberating" Aleppo, even the Western media concedes it is a bastion of government support. This indicates that terrorism, intimidation, and panic, not "liberation" are the FSA's goals in Aleppo, and that the government is justified to take any measures necessary to stop them.

Conversely, NATO and its allies see Syria's vigorous defense capabilities as an obstacle to Western-planned regime change - therefore if neutralizing them through covert  means is not possible, they will attempt to neutralize them by declaring them a threat to "civilians," invoking "Responsibility to Protect," and initiating foreign military intervention.
